How to Have Tint Legally in California: The Rules for Every Window

To have tint legally in California, use any shade on the rear side windows and, if both outside mirrors work, the back glass. Front side windows: clear 88% film only, with the installer's certificate in the car; the windshield, a top strip. A physician's or optometrist's letter covers removable sun screens only; clear 88% windshield film needs a dermatologist's certificate.

Is 15, 20, 30 or 35 percent tint legal in California? On the rear side windows and back glass, yes. On the front side windows, no, whatever the number, unless it is clear 88% film. The rules are state law, the same in Los Angeles as everywhere else in California (VC 21). Section 26708 was last amended effective 1 January 2026, for truck safety technology; the tint rules did not change. How each shade looks: is 35 or 20 tint darker.

Front side windows: why a 70% film still fails

Two numbers apply at once: the film must pass at least 88% of visible light, and the window with film must still meet the 70% minimum of federal safety standard FMVSS 205 (26708(d)). Factory glass already blocks some light, so a film's name is not the reading on your car. On 3M's 73% reference auto glass, its Ceramic IR films read (3M):

Will I get pulled over for 50% tint in California? On the front side windows it is illegal and can be ticketed; at the back it is legal.

The certificate must be signed by the installing company and name it and the film maker by full name and street address; if you applied the film yourself, the maker signs it. Front film that tears, bubbles or wears enough to block clear vision must be removed or replaced (26708(d)). Why film fails: how long window tint lasts.

Windshield: the 29-inch line, not "the top 4 inches"

Many tint pages cite "the top four inches" or the AS-1 mark on the glass. The Vehicle Code says neither. It sets the line from the driver's seat (26708(c)), so it sits at a different height in every car. To find it:

    Put the car on a level surface.

    Set the seat

    Move the driver's seat all the way back and all the way down, with nobody sitting in it.

    Find the point

    Mark the seat five inches in front of the bottom of the backrest.

    Measure 29 inches up

    The strip's bottom edge must sit at least 29 inches above that point.

The code sets no percentage for the strip, only the color, lettering and glare limits in the table above.

Is 70% windshield tint legal in California? No. Below the strip, the only film allowed is clear, colorless film of 88% or more, and only with a licensed dermatologist's certificate that the person should not be exposed to ultraviolet rays (26708(e)). A 70% film is neither. Even the clear film sits awkwardly in the code: the section that makes applying film unlawful excepts subdivisions (b) to (d) of 26708, not (e) (26708.5). We don't film the whole windshield.

Can I put ceramic tint on my windshield in California? As a top strip, yes: ceramic is a kind of film, not a separate rule. What it is and how it differs from carbon: what is ceramic window tint.

Medical exemptions: removable shades or clear film, never dark film

California has two medical exceptions, and neither allows dark film on the front side windows.

1. Sun screens, with a doctor's or optometrist's letter. A driver or front passenger carrying a letter from a licensed physician and surgeon (medical condition) or optometrist (visual condition), certifying they must be shaded from the sun, may use sun-screening devices on the front side windows (26708(b)(10)). The devices must (26708.2):

  • come off readily: a frame, a rigid panel with temporary fasteners, or a roller shade;
  • if see-through, be green, gray or neutral smoke and pass at least 35% of light;
  • if louvered, be at least 35% open, with no louver taller than 3/16 inch;
  • reflect no more than 35% on either side;
  • never be used in darkness.

2. Clear film, with a dermatologist's certificate. A licensed dermatologist can certify that a person should not be exposed to ultraviolet rays. That allows clear, colorless 88% film on the windshield, side or rear windows (26708(e)), not tint.

The statute asks only for the signed letter or certificate, kept in the car. There is no DMV application or permit, and no letter makes dark applied film legal.

What a tint ticket costs, and how to clear one

Illegal tint is an equipment infraction, so officers normally write a notice to correct, the fix-it ticket (VC 40303.5). They may write a regular ticket instead for fraud or persistent neglect, an immediate safety hazard, or a driver who cannot fix it promptly (VC 40610).

Los Angeles is one of 30 counties allowed to set totals above the statewide schedule (the schedule's preface lists them), so the notice from LA Superior Court is the figure that counts. The schedule lists no DMV points for an unlawful-material violation.

How to clear a fix-it ticket in Los Angeles

    Fix the windows

    Remove the illegal film, or replace the front film with clear 88% film and get the installer's certificate. The officer sets the time on the notice, up to 30 days (VC 40610).

  2. 02

    Get the sign-off

    Any police department, the CHP, a sheriff or a marshal can certify the correction (VC 40616). LA Superior Court says to get it at any law enforcement office during business hours (LA Superior Court).

  3. 03

    Send proof and the fee

    Mail the signed proof, the payment coupon and 25 dollars per corrected violation, payable to LA Superior Court, in the return envelope. The due date on the ticket is a deadline to act, not a court date.

Defenses are narrow: the windows are factory-tinted glass that meets federal standards (26708.5(b)), the front film is clear 88% film with its certificate, or the shade is a medical sun screen used as described above. At 25 dollars against 193, correcting usually costs less than losing a contest. This guide is general information, not legal advice.

Tint meters, and how tint is enforced

A tint meter shines light through the glass and reads how much reaches a sensor on the other side. Laser Labs, a meter maker, builds its police meter to slip over a rolled-down side window and work one-handed; its two-piece inspection meter reads any window, windshields included, with one half inside the car. Normal water spots don't change a reading (Laser Labs).

A meter reading is not the only evidence. In People v. Hanes (1997), the Ventura County Superior Court's appellate department upheld a stop where the officer saw more than tint (front windows so dark they looked black and hid the occupants), and held that an officer's commonsense opinion can support a conviction with no scientific testimony (People v. Hanes).

Is tint law enforced, and how do some cars get away with it? Not being stopped does not make film legal. Two exceptions explain cars that look illegal and are not: vehicles that agencies run for their peace officers are exempt from the side and rear window rules (26708.7), and factory-tinted safety glass is allowed where federal standards permit it (26708.5(b)). The law also reaches the installer: applying film that darkens the glass outside the exceptions is itself unlawful (26708.5(a)).

Registration, out-of-state plates and leased cars

Will dark tint cause problems registering my car? Registration includes no window check: gasoline and hybrid cars past their first eight model years need a smog check every other year at renewal (electric cars never do), and a car's first California registration can need one too. The check inspects the emission controls, not the glass (BAR). The tint can still be cited on the road.

Can I have window tint with out-of-state plates? Section 26708 applies to anyone driving in California and makes no exception for cars registered elsewhere, so front tint that is legal in your home state can be cited here. If you move here, you have 20 days to register the car after you become a resident or take a job in California (DMV); that is the time to switch the front windows to clear film.

Can you tint a leased car? The law is the same for leased and owned cars. The lease adds its own terms: Toyota Financial Services, for one, lists "non-factory tinted glass" among its examples of excess wear and use at lease end (Toyota Financial Services). Read that section of your lease before tinting; old-tint removal is priced on car window tint.

Checklist for a legal tint job

  • Clear film of 88% or more on the front side windows, metered on the car so glass plus film reads 70% or more.
  • The installer's certificate, naming the installer and the film maker with full names and street addresses, kept in the car.
  • A windshield strip whose bottom edge sits above the 29-inch line, in any color but red or amber.
  • Nothing on the rest of the windshield, unless clear 88% film with a dermatologist's certificate.

Is factory privacy glass legal in California?

Yes. Glass tinted when it is made is allowed where it meets federal safety-glazing standards for its location (Vehicle Code 26708.5(b)). The limits in this guide apply to film and other material added later: film over factory glass at the back is legal in any shade, while the front side windows still take only clear 88% film with the certificate.

I bought a used car with dark front tint. Can I be ticketed?

Yes. Section 26708 makes it an offense to drive a car with the material on the glass, so the driver is cited, whoever applied the film. Have the front film removed or replaced with clear 88% film, and keep the new installer's certificate in the car.

Will a tint shop install dark front film if I sign a waiver?

A waiver does not change the law. Applying film that darkens the front side windows, outside the clear 88% exception, is unlawful for whoever applies it (Vehicle Code 26708.5(a)), and the driver can still be cited. A shop that says no is following the code.

Is 35% windshield tint legal, or safe at night?

Not below the top strip: there the only film California allows on the windshield is clear 88% film, with a dermatologist's certificate (26708(e)). The strip itself has no percentage limit, only the color, lettering and glare rules, so a 35% strip above the 29-inch line can be lawful. For 35% over the whole windshield, the night evidence points the same way. In a driving-simulator study reviewed for the Virginia Transportation Research Council, drivers picked out fewer low-contrast targets in simulated twilight through a 40% windshield, and drivers who wore glasses already did worse at 58% (VTRC 96-R14); a 35% windshield is darker than both. How age and shade change the view out: can you see out of tint at night.

Do I need a certificate for tint on the rear windows?

No. The installer's certificate is required only for film on the front side windows (Vehicle Code 26708(d)). The rear side windows and back glass need no paperwork, but tint on the back glass needs outside mirrors on both sides of the car.
